MBKeyless.com Terms and Conditions
English version dated 26 September 2026. Based on the Polish version of 25 September 2026.
1. Seller and contact details
MBKeyless.com is operated by Paweł Choszczyk, trading as Creman – Paweł Choszczyk, registered in Poland's Central Register and Information on Economic Activity (CEIDG). Address: ul. Stefana Batorego 18/108, 02-591 Warsaw, Poland. Tax ID (NIP): 9522260213.
For orders, complaints, returns and questions about the shop, contact shop@mbkeyless.com or call +48 796 129 339. The postal address for correspondence, complaints and returns is the address above. We charge no extra contact fee; your operator may charge its standard rate.
These terms govern purchases and the shop's free electronic services. You may save or print them free of charge before entering into a contract. Information about personal data is in the Privacy Policy.
2. Who these terms cover and what we sell
Consumers and businesses may buy from the shop. A consumer is an individual making a purchase that is not directly related to their business or profession.
We also apply the provisions on withdrawal and statutory conformity of goods to an individual entering into a contract directly related to their business if the contract is not professional in nature for that individual, in particular in light of the business activities disclosed in CEIDG. Giving a tax ID alone does not remove these rights.
We sell products for repairing Keyless Go systems. Each product description specifies its contents, compatibility, properties and installation requirements. Check your car model and product variant before buying; contact us if in doubt. A standard kit selected for a vehicle model or side of the car does not thereby become a product made to the customer's individual specifications.
Expressing interest in a future product or signing up for an availability notification is not an order, reservation or obligation to pay.
3. Ordering and entering into a contract
- Choose the products and quantities, add them to the cart, provide the details needed to fulfil the order, and select an available delivery and payment method. You can buy with or without a customer account.
- Before placing an order, you can correct your details and cart. Check the products, delivery address, currency, taxes, delivery cost and total payable in the summary. Read these terms.
- Place the order using the final button that clearly indicates an obligation to pay. Placing an order is an offer to buy the products it describes. Adding a product to the cart alone does not form a contract.
- The sales contract is formed when you receive our email confirming that we have accepted the order for fulfilment. A notification from a payment provider alone is not that confirmation.
- We provide confirmation of the contract, its terms, withdrawal instructions and withdrawal form on a durable medium, such as the body of an email or an attachment, no later than delivery of the goods. The terms of a particular order remain valid if the website changes later.
If we cannot accept an order, we will tell you and refund any payment received. Once a contract has been formed, we do not unilaterally change its price or subject matter. Contact us as soon as possible if you notice an error in your details.
4. Prices, payment and delivery
Prices and currency depend on the market and delivery country. For consumers in Poland and the European Union, the amount payable includes applicable VAT. Delivery cost is shown separately before the order is placed. After you enter an address, the shop may recalculate the currency, VAT rate and delivery; you see the final summary before ordering. We do not charge you for an additional service or fee without your express consent.
Delivery outside the European Union may incur local import taxes, customs duties and clearance fees that the shop does not collect. Unless the offer states otherwise, delivery is on DAP terms: the recipient pays these charges under the importing country's law. Their amount depends on the destination, type and value of the goods and may be determined by the relevant authority or carrier. Information about such charges should be available before placing an order.
Electronic payments are handled by Stripe or PayPal, depending on the method chosen. The specific methods, availability of cash on delivery and any charges are shown during checkout and depend, among other things, on the country and currency. Not every method is available for every order. Advance payment must be completed before dispatch; if cash on delivery is available, you pay on receipt.
We deliver to countries served by the shop. Enter the delivery country to see available methods and their cost. If no method is available for a country, a standard order for delivery there cannot be completed; individual terms can be agreed before purchase. We use carriers including DPD and FedEx.
We usually dispatch orders within 2–3 business days. The maximum dispatch period is 10 business days after payment confirmation or acceptance of a cash-on-delivery order, unless a different binding period was stated in the offer or individually agreed before purchase. Preparation may take longer than usual, in particular because of material shortages or production disruptions. We also state “usually 2–3 business days, at most 10 business days” before an order is placed.
If we expect to dispatch later than usual or a delay occurs, we promptly tell the customer the reason and expected dispatch date. This notice alone does not extend the maximum or other binding contractual deadline. The customer's statutory rights relating to delay remain intact, including the right to terminate the contract under the applicable rules, as does the separate right to withdraw from a distance purchase described in section 5.
Business days are Monday to Friday, excluding Polish statutory holidays. The dispatch period ends when the parcel is handed to the carrier; transit time depends on the method and country. A specific fulfilment period is stated in the offer or agreed before the contract is formed. Unless a different period has been agreed, we deliver the goods without undue delay and no later than 30 days after the contract is formed.
In a consumer sale, the risk of accidental loss or damage passes to you when the goods are handed over to you or a person you designate other than the carrier. An exception applies if the consumer independently chose a carrier we did not offer. Inspecting the parcel and preparing a damage report can help establish what happened, but failing to do so does not take away your statutory complaint rights.
5. Withdrawal from a distance purchase — return without giving a reason
A consumer and a business buyer covered by the protection described in section 2 may withdraw from a distance contract within 14 days without giving a reason.
For goods, the period starts when you or a person you designate other than the carrier takes possession of them. If a single order contains goods delivered separately, in batches or in parts, it starts on receipt of the last item, batch or part. For a service contract, it starts when the contract is formed. The day of the event starting the period is not counted.
To withdraw, send a clear statement, for example by email to shop@mbkeyless.com or by post to the address in section 1. You may use the form at the end of these terms, but you do not have to. You do not need our prior approval or a return authorisation number. Sending the statement before the period expires is sufficient.
Return the goods to Creman – Paweł Choszczyk, ul. Stefana Batorego 18/108, 02-591 Warsaw, Poland, no later than 14 days after withdrawal. Dispatching them before that period expires is sufficient. You bear the direct cost of returning goods under this withdrawal right. This cost does not apply to a justified complaint that the goods do not conform to the contract.
We refund payments received, including the cost of the least expensive standard delivery method offered for the order, without undue delay and no later than 14 days after receiving your withdrawal statement. We do not refund any extra charge for a more expensive delivery method you chose. We may withhold the refund until we receive the goods or proof that you sent them back, whichever comes first, unless we offered to collect them.
We refund using the same payment method unless you expressly agree to another method at no extra cost to you. For cash-on-delivery purchases, we will agree how to refund you. We do not require original packaging or a receipt as the only proof of purchase.
You may examine the nature, characteristics and functioning of the product to the extent needed to become familiar with it. You are liable for any loss of value caused by handling beyond that extent, unless we failed to inform you of the withdrawal right as required by law. Installing, permanently gluing or damaging a product may reduce its value, but does not automatically remove the withdrawal right. We charge no fixed return handling fee.
If a consumer was not properly informed of the withdrawal right, it expires 12 months after the end of the ordinary withdrawal period. If proper information is provided during those 12 months, the period ends 14 days after the information is received.
6. Repair and installation services
Mail-in door handle repairs and on-site installation require separate agreement on scope, total price, transport and timing. The service price is not automatically included in the DIY kit price. We offer mail-in repairs to customers in the European Union. Do not send door handles before agreeing the service with us.
If a service ordered at a distance is to begin before the 14-day withdrawal period ends, we need your express request and your acknowledgement that you will lose the right to withdraw after the service is fully performed. Accepting these terms alone does not replace those statements.
If you withdraw after service began at your express request but before it is fully performed, you pay proportionately for the work performed, provided we met the statutory information duties. After full performance, the withdrawal right expires only if all statutory conditions were met, including prior express consent and notice of the loss of the right. This does not limit complaints about faulty service.
For purchases made in person at our premises, a statutory no-reason return right generally does not apply. Rights arising from defective goods or services remain intact.
7. Complaints — statutory liability for goods
We must supply goods that conform to the contract. To a consumer and a business buyer protected under section 2, we are liable for nonconformity existing at delivery and becoming apparent within two years of delivery, unless a stated shelf life is longer. Nonconformity appearing during that period is presumed to have existed at delivery unless we prove otherwise or that presumption is incompatible with the nature of the goods or nonconformity.
You may request repair or replacement. Changing your chosen remedy or refusing to bring goods into conformity is possible only in cases allowed by law, in particular if the requested remedy is impossible or would entail disproportionate costs. Repair or replacement is free of charge, within a reasonable time and without significant inconvenience to you.
You may request a price reduction or terminate the contract because of nonconformity if we refused repair or replacement, failed to perform it properly, the nonconformity remains despite an attempt to remedy it, it is serious enough to justify an immediate remedy, or the circumstances show that we will not remedy it within a reasonable time or without significant inconvenience. Termination is unavailable for minor nonconformity; we must prove that it is minor.
We pay complaint costs required by law, including transport, labour and materials. You make the goods available and we collect them at our expense. If the goods were installed in line with their nature and purpose before nonconformity became apparent, we remove them and reinstall them after repair or replacement, or arrange this at our expense.
We refund a price reduction without undue delay and no later than 14 days after receiving your statement. If you terminate because of nonconformity, you return the goods at our expense; we refund the price without undue delay and no later than 14 days after receiving the goods or proof of return. The refund uses the same method unless you expressly agree to another at no extra cost. You may withhold payment of the price until we fulfil our statutory complaint duties.
Submit a complaint by email, post or phone using section 1's details. Describe the problem and requested remedy and give details allowing us to contact you and identify the purchase. An order number and photos may help, but are not conditions for accepting a complaint. We do not require original packaging or a receipt. We answer a consumer on a durable medium within 14 days of receiving a complaint; failing to answer within that period means the complaint is accepted to the extent provided by law.
Installing the kit yourself does not take away statutory rights. Liability does not cover damage caused by the customer, but we cannot reject a complaint in advance solely because the customer installed the kit. We are also responsible for incorrect installation performed by us or under our responsibility, and for installation by the customer if the error resulted from defective instructions.
For business buyers not protected under section 2, the relevant provisions of the Polish Civil Code apply. These terms do not generally exclude their statutory warranty for defects. We handle complaints about repair and installation services under the applicable law; they can be submitted through the same channels.
8. MBKeyless commercial warranty
We provide a 12-month commercial warranty for MBKeyless repair kits from the date the product is handed over to the buyer. The warrantor is Creman – Paweł Choszczyk, with the details in section 1. It covers products delivered to countries served by the shop and defects in materials or workmanship arising during use according to the product's purpose and instructions. More favourable terms stated at purchase remain binding; this version does not shorten a warranty granted earlier.
To claim under the warranty, report the problem using section 1's contact details and make the product available. We restore proper function by repairing or replacing the product at our expense, respecting the buyer's mandatory rights. Unless the warranty document specifies another lawful period, we meet our obligations without undue delay and no later than 14 days after the product is delivered to us. Article 581 of the Polish Civil Code governs the warranty period following replacement, substantial repair and periods during which the product could not be used.
This commercial warranty is additional. It does not exclude, restrict or suspend statutory rights arising from nonconformity of goods with the contract. You choose the basis for your complaint. Expiry of the one-year warranty does not end the seller's two-year liability described in section 7.
9. Account and other electronic services
We provide browsing, the cart and order form, customer accounts, the contact form and availability notifications where a sign-up form is shown, free of charge. You need an internet connection and a current browser supporting JavaScript and essential cookies. A working email address is needed for orders, accounts and correspondence. Optional marketing cookies are not required for purchase.
The cart and forms are available for the duration of their use. An account service contract begins when registration is completed and continues indefinitely. You may end it at any time, free of charge, by writing to shop@mbkeyless.com. Closing an account does not cancel orders already placed or erase data we must retain by law.
We send availability notifications within the scope stated at sign-up and covered by your consent. You may unsubscribe at any time by email. Signing up does not imply consent to other marketing activities.
Provide accurate details, protect your password and do not give unauthorised people access to your account. You must not provide unlawful content, infringe others' rights or disrupt the shop. These services themselves are free, apart from your operator's ordinary connection costs.
Report problems and complaints about electronic services using section 1's contact details, describing the issue and providing contact details for a reply. We answer on a durable medium within 14 days. This does not exclude rights given by law.
10. Disputes, governing law and changes
You may seek help from a municipal or district consumer ombudsman, the Polish Trade Inspection and out-of-court dispute resolution. Information on relevant bodies and procedures is available from UOKiK — out-of-court dispute resolution. Participation is governed by the applicable law and the relevant body's rules. If a dispute remains unresolved after a complaint, we provide the consumer, on a durable medium, the required statement agreeing or refusing to participate in such proceedings. These terms do not require mediation before going to court.
Polish law governs the contracts. This choice does not deprive a consumer of the protection of mandatory provisions of the law of their habitual residence, where applicable. Court jurisdiction is determined by law; we do not impose exclusive jurisdiction of a Warsaw court on consumers.
The terms in force when an order was placed apply to that order. A new version does not change existing sales contracts or acquired rights. Changes to ongoing services require a legal basis or agreement with the customer; publishing new text alone does not amend an existing contract. No provision excludes or restricts rights that cannot lawfully be excluded or restricted.
